ASHEVILLE, N.C. — Asheville police have identified Andrew Joseph Kolvick, 71, as the pedestrian killed after being struck on Tunnel Road on Sept. 10, and said no charges will be filed against the driver.

Police released Kolvick’s name on Oct. 7 after next of kin was notified. Officers responded about 8:16 p.m. Sept. 10 on a report of a pedestrian struck by a vehicle in east Asheville.

Andrew Joseph Kolvick was struck Sept. 10 near the intersection of Tunnel and Riceville roads. According to the preliminary investigation, a 2016 Nissan Rogue was traveling eastbound on Tunnel Road through a green light at the Riceville intersection when it struck him.

The driver remained at the scene. Kolvick was taken to Mission Hospital, where he died from his injuries.

After completing the investigation and consulting with the Buncombe County District Attorney’s Office, Asheville police said no charges would be filed against the driver. Police did not detail the reasoning behind that charging decision in the public identification release.

The crash investigation spanned from the Sept. 10 response through the Oct. 7 identification announcement. A Sept. 15 police update had already described the Nissan Rogue traveling east on Tunnel Road through a green light when the pedestrian was struck.

Mission Hospital is Asheville’s primary hospital system for seriously injured crash patients. City investigative work on the Tunnel Road case was handled by Asheville police detectives who later briefed prosecutors before the no-charge announcement.
